Why Donald Trump is set to declare a national emergency to build his wall - and what will happen nex - Duration: 15:42.

 Donald Trump is poised to declare a national emergency in an attempt to fund his US-Mexico border wall without congressional approval

 The White House said the US President would sign a spending bill that would avert a government shutdown, but which only provides $1

375 billion for border barriers or fencing - far from the $5.7 billion Mr Trump wants

 "President Trump will sign the government funding bill, and as he has stated before, he will also take other executive action - including a national emergency," White House spokeswoman Sarah Sanders said

 The prospect of Mr Trump declaring a state of emergency to build his border wall had appeared more likely after he backed down in the shutdown standoff last month without securing funds for the barrier

     The specter of such action has produced widespread opposition in Congress, but Mr Trump is under pressure to soothe his conservative base and avoid looking like he's surrendered in his wall battle with Congress

 Such a move has been done before by past presidents but this time it would almost certainly face legal challenges

What is a national emergency?  Passed in 1976, the National Emergencies Act allows the president to pronounce a national emergency when he deems it appropriate

 The act offers no specific definition of "emergency", but the use of it has rarely been controversial

 However, because it allows a president to declare one entirely at his or her discretion, critics are accusing Mr Trump of "fabricating" a crisis at the southern border

  Why an emergency declaration?  The administration has spent months trying to figure out how the president might be able to move forward with the wall - the central promise of his 2016 campaign - if Congress refuses to give him the money

 As early as last March, Mr Trump was publicly floating the idea of using the military for the task

   But it's Congress - not the president - that controls the country's purse strings and must appropriate money he wants to spend

 A emergency declaration, however, bypasses Congress. The White House counsel's office is reviewing the option and among the laws Mr Trump could turn to is Section 2808 of the Title 10 US Code pertaining to military construction

 According to the statute, if the president declares an emergency "that requires use of the armed forces," the Defence Secretary "may undertake military construction projects, and may authorise the Secretaries of the military departments to undertake military construction projects, not otherwise authorised by law that are necessary to support such use of the armed forces"

 Pentagon budget officials are analysing the 2019 construction budget to determine how many dollars would be available to use for the wall if Mr Trump opts for that path

Under the provision, only those construction budget funds that are not already set aside for other construction projects could be used for the wall

 There are more than 100 such provisions giving the president access to special powers in emergencies

And Congress has typically afforded the president broad authority to determine what constitutes an emergency and what does not, said Elizabeth Goitein, co-director of the liberty and national security programme at the Brennan Centre for Justice

 "Absolutely it's an abuse of power for the president to declare a national emergency when none exists and to use it to try to get around the democratic process," she said

"But we are in a situation where our legal system for emergency powers almost invites that kind of abuse

" What would happen then?  Declaring an emergency to build the wall would likely trigger a torrent of legal challenges questioning the president's authority as well as whether the situation at the border really constitutes an emergency

Mr Trump has been trying to press that case in recent weeks, insisting the situation qualifies as a security and humanitarian "crisis

"  He'll also face other questions.  "The problem for the Trump administration is that border security is fundamentally a law enforcement issue that does not require the use of the military," said Todd Harrison, a defence budget expert at the Centre for Strategic and International Studies

"So I think they would be on shaky legal ground trying to use emergency authorities this way, and it is almost certain that they would end up in court

"  Asked if she would file a legal challenge to an emergency declaration, House of Representatives Speaker Nancy Pelosi said: "I may, that's an option

"  Sen. Jack Reed, the ranking Democrat on the Senate Armed Services Committee, said it would be inappropriate for Mr Trump to use Section 2808

 "We are not at war with Mexico, and the proposed border wall has no core (Defence Department) function

Indeed, the Pentagon's most recent National Defence Strategy doesn't mention the southern border as a national defence priority," Mr Reed said

 Adam Smith, House Armed Services Committee Chairman, said even if Mr Trump could declare an emergency, it would be a "huge mistake

"  "There clearly is no national emergency. But they asked me, 'Can he do it?' Yeah he can

It would be wrong, it would be horrible policy and I'm totally and completely against it

But from a legal standpoint he can do it," Mr Smith told CNN.  He and others agreed any declaration would surely be challenged in court

Has it been done in past?  National emergencies have been declared by a number of presidents in the past, mostly when it comes to economic sanctions against foreign actors whose activities pose a national threat

   Bill Clinton declared emergencies 17 times, one of which was announced during the Cuba embargo in 1996, when US ships or aircraft were prevented from entering Cuban territory without authorisation

 Barack Obama, meanwhile, declared one when tackling  the H1N1 Swine Flu epidemic in 2009 in order to arrange proper patient treatment

 One of the 31 national emergencies still in effect is that declared by George W Bush in the wake of the terrorist attacks of September 11, 2001

How could Congress or the courts challenge it?  While Mr Trump can declare an emergency when he wants, Congress theoretically does have the authority to cancel it - though such a move would be unprecedented

    The National Emergencies Act gives lawmakers authority to reject a declaration through legislation that would require majorities in the House and Senate

 Mr Trump would likely veto bill, after which lawmakers would have the chance to override it with a two-thirds majority vote

With Republicans in control of the Senate, that of course would be a tall order in the current climate

 The declaration would likely face a legal challenge in the courts, where presidential declarations have rarely been voided

   In 1952, President Harry Truman declared an emergency to take control of steel factories during the Korean War in response to a labour strike

By a 6-3 vote, the US Supreme Court ruled against the president. In an influential opinion, Justice Robert H

Jackson said Truman's reliance on emergency power under the Constitution would hand too much power to the president - in stark opposition to the wishes of the framers

 However, that preceded the 1976 Act, which leaves the existence of an emergency wide open to interpretation

   "If President Trump declares a national emergency at the border, it is far from clear that courts would strike it down," writes Chris Edelson, Assistant Professor of Government at American University School of Public Affairs

Where would the money come from?  Shifting money from accounts to deliver the $5

7 billion he wants will be tricky.   The administration has been eyeing several pots of money - including disaster funds, counter-narcotic accounts and military construction dollars - to fund Mr Trump's wall, according to congressional aides and White House officials

 One possibility is shifting a portion of the $13 billion in disaster aid Congress approved last year for Puerto Rico and a dozen states, including California and Texas, hit hard by hurricanes, flooding and other disasters

The money funds Army Corps projects, and the Puerto Rico aid alone totals more than $2 billion

 But Texas lawmakers revolted over White House plans to tap Hurricane Harvey funds, and Sen

John Cornyn said on Thursday they won assurances from the White House that the money won't be used for the wall

 A more likely option is the military construction account that's used to upgrade bases and facilities

 Congressional aides said there is $21 billion available. That includes about $10 billion in funds from the current 2019 fiscal year that ends September 30, and $11 billion remaining from the previous four years, said the aides

   But tapping the military construction money also may hit resistance. The money often goes for improvements to housing, roads, hospitals and other facilities, and can be used to eliminate mold or other hazardous problems at military installations in congressional districts across the nation and around the globe

 Potentially easier to tap is the military's counter-drug account, so-called Section 284 money, as suggested by Rep

Mark Meadows, a Trump ally and leader of the conservative Freedom Caucus. But it falls short of what's needed with about $800 million available

Is Caster Semenya A Biological Male? - Duration: 5:05.

The Times reported that the lawyers of the International Association of Athletics Federations,

IAAF, will say Caster Semenya, is a biological male, as well as a female.

Semenya's lawyers say, Semenya is "unquestionably a woman", before a court case against the

athletics' governing body.

Semenya lawyers are Norton Rose Fulbright.

She is challenging a proposed IAAF rule that aims to restrict the levels of testosterone

in female runners.

The IAAF denied on Wednesday that it will class any athlete with "differences of sexual

development, DSD," as male.

"Ms Semenya is unquestionably a woman," said Semenya's lawyers in a statement on Thursday.

"She is a heroine and an inspiration to many people around the world.

"Ms Semenya is fighting for her right to run without being required to undergo unnecessary

medical intervention.

She is fighting to run free."

The case will be heard at the Court of Arbitration for Sport, CAS, next week.

The IAAF intended to bring in new rules on 1 November last year, but put that back to

26 March to wait for the outcome of the legal challenge from Caster Semenya and Athletics

South Africa.

The rules will apply to women in track events from 400m up to the mile, and require that

athletes have to keep their testosterone levels below a prescribed amount, "for at least six

months prior to competing".

Semenya's lawyers said she asks to be "respected and treated as any other athlete".

"Women with differences in sexual development, have genetic variations that are no different

than other genetic variations that are celebrated in sport," they said.

"Her genetic gift should be celebrated, not discriminated against."

The IAAF said it accepted the legal sex of DSD athletes, of whom Semenya is the most

notable, "without question", and permit them to compete in the female category.

"However, if a DSD athlete has testes and male levels of testosterone, they get the

same increases in bone and muscle size and strength and increases in haemoglobin that

a male gets when they go through puberty, which is what gives men such a performance

advantage over women," it added.

"Therefore, to preserve fair competition in the female category, it is necessary to require

DSD athletes to reduce their testosterone down to female levels before they compete

at international level."

IAAF lawyer, Jonathan Taylor, told The Times that if CAS rules that the governing body

cannot implement the new rule, "then DSD and transgender athletes will dominate the podiums

and prize money in sport, and women with normal female testosterone levels will not have any

chance to win".

In response, Semenya's lawyers said: "There are different regulations for DSD athletes

and transgender athletes.

"Ms Semenya respects the rights and interests of transgender athletes around the world.

"Her case, however, is about the rights of women such as Ms Semenya, who are born as

women, reared and socialised as women, who have been legally recognised as women for

their entire lives, who have always competed in athletics as women, and who should be permitted

to compete in the female category without discrimination."

Semenya, a two-time Olympic champion and three-time world champion, has previously been asked

to undertake gender testing by athletics chiefs, but no results have officially been made public.

Her lawyers repeated the statement that Semenya made when she announced she would fight the

rules last year: "It is not fair.

I just want to run naturally, the way I was born.

"It is not fair that I am told I must change.

It is not fair that people question who I am."

I'm just a guy that makes really cool tasty vertical content

I just said tasty and part of what I hear on YouTube is yeah I upload some of

that vertical content but I also teach you how to do everything that I do from

the vertical filmmaking perspective that includes showing you all the gear that I

use and how to use it and yes with videos like this it is annoying to waste

some time so let's get right into it let's talk about vertical filmmaking

mobile lenses

my good friends at Sandmarc sent me some really cool epic mobile gear to

support my vertical filmmaking so a thank you for that and they sent this

stuff to me a while ago what you're looking at here is Sandmarc's wide-angle

lens they also sent me a Tele lens and some nd filters icing on the cake nd

filters for a mobile device I never thought those existed I'm not in a boxer

but real quick what's in the box for the wide angle lens box you got the wide

angle lens of course a phone case to screw on the lens a really nice pouch

not microfiber but still really nice and it even works for your glasses and of

course the lens... oh yeah that's nice I love the fact that it comes with two

lens caps one for the front and one for the back that's awesome and an external

lens clip which is super important because well you want to use it for

multiple phones if you shoot with multiple phones I use an iPhone XS Max

switch that's what the case is and I also shoot with an iPhone 7 plus

the other reason why the external clip is super cool is because you can use it

for your front facing or selfie camera of course we do front facing cameras or

selfie cameras are prime for Instagram stories right again vertical video let

me show you comparison with and without the wide-angle lens on a front facing camera.

Now as far as what comes with the telephoto lens

it's everything that the wide angle lens came with now let's get into some

details on the wide-angle lens and why you need it for your vertical

filmmaking vertical vlogs or whatever you're doing this one angle lens gives

you a 16 millimeter look which is similar to what you're looking at right

here this is a 15 millimeter lens that I'm using which means what it brings out

your shot it gives you a wider shot let's do some compare and contrast real

quick here's a random clip of me shooting stuff outside without the lens

this is just my iPhone XS Max shooting natively cut to this shot of me using

the Sandmarc wide-angle lens you can totally tell the difference with this

compare and contrast right here so when you think about a wide lens like this

one use it for A roll which is what you're looking at right now if you're

not familiar A roll is essentially your narrative or your dialogue your context

of your video A role killer for sure let's move on another critical thing

this wide-angle lens does for your phone is it doubles your field of view if you

notice with your rear camera or especially your front-facing camera you

just feel so cropped in like this one of the hardest things to do when it comes

to vertical filmmaking or vertical vlogging is taking

footage of yourself especially when you're using the rare camera which you

should be using it's preferred to use that camera because it has more of the

megapixels and it just looks better and now we're vlogging on the wide-angle

lens I'm literally just holding the phone but check this out

you can like see my toes this lens just widens your field of view so much giving

you a 16-millimeter look it just looks cool now let's try it without here it is

without you can tell the difference immediately right I'll give you a side by side comparison

Now when using your rear camera on your phone that's almost

impossible because hey you can't see yourself so you're just kind of like oh

so you're kind of just like oh I can't see myself I don't know if I'm in frame

or not like you can use this lens with your selfie camera and that clip and you

eliminate all of those issues instantly oh and one last pro tip when

it comes to the one angle lens if you take the wide-angle lens and put it down

on the second notch on the case which covers up to telephoto lens on your

phone that's why there's two you can actually get a really cool 24 millimeter

look and you can even pop in some bokeh but there's a caveat to this listen for

this part otherwise it's not gonna work all the Sandmarc videos that I watched

and everyone reviewing these lenses didn't mention this if you just screw it

on natively on the iPhone camera app you can see that just blacks out your frame

reason being is your camera app in video mode only shoots with the wide-angle lens

which makes sense your telephoto lens is only there for portrait mode as you can

see so the trick to get this really nice detailed 24 millimeter look with that

wide-angle lens is to use an external app that allows you to switch your

cameras manually such as filmic Pro go into your settings you go to camera you

have the option to switch between your wide angle lens your telephoto lens and

your selfie camera so select the tele and boom it opens right up and it gives

you a really cool 24 millimeter look which is great because you know iPhones

don't have lenses that can do that that's why you get externals and then

you pair it up with filmic Pro and awesome and yes you can do that with the

telephoto lens that's enough about the wide and I think you got the point you can

see with all those comparisons and contrasts

now let's talk about the telephoto lens this is your b-roll machine your b-roll

master with this tele lens you're able to shoot clean detailed buttery

landscape footage b-roll footage of anything architecture the sky's the

limit what you can do with this thing this gives you a very similar look

between a 50 millimeter and a 60 millimeter lens so it gives you a two

time zoom which depending on what your subject is you can get really nice bokeh

or very good detailed shots from afar

and so that's why you would want a Tele lens like this is to shoot some really

awesome b-roll just make sure you don't vlog with the tele lens because like now

when it comes to the case itself I like it a lot because it's pretty slim

I just like the way it looks and I'd really hate bulky cases yeah I got to

tell you I don't know if this will really protect a phone that's super

important for mobile filmmaking is we have our phones all the time not only

are there our primary shooters but we live on our phones so if it's broken and

you get the shattered glass of death well that sucks I do have a broken dud

of iPhone 6 plus is this a 6 plus? 6S? and I've already checked it

actually fits the case yeah so you know what we're gonna do we're gonna go

outside and see if this thing really holds up dropping on concrete

it's like super cold out here so I'm just gonna do this click and drop it I think what I'm

gonna do is drop it from the point of view the angle in which I feel we would

be shooting vertical video maybe like here

okay so it didn't fare too well firstly yeah pop that is case so there's that

and second it clipped like chip some of it I don't know how I dropped it kind of

like that so yeah the case should still work for the lenses that's good and it

did protect my phone I did drop it almost six feet or so phone's fine the

case just took damage and the last thing I want to talk about really fast are

these guys right here these are mobile ND filters for these lenses I didn't

know these really existed I mean quality ones at least you can go on Amazon to

get like really plasticky ones this stuff is pure glass super top-notch

stuff equivalent to what I use on my DSLR's or my mirrorless cameras metal

threading all throughout which allows you to pop them right on both lenses

both lenses are the same ring shape and size so these are interchangeable

amongst a wide and the telephoto and they give you this pack of three with the

3-prime neutral density layers and ND4 ND8 and ND16 PS if you don't know

what a ND filter is it stands for a neutral density filter what's

essentially allows you to make your footage a lot crisper sharper and

supports your visibility and exposure with harsh light now outside as you saw

with the B-Roll and earlier in intro it's pretty overcast outside but you can see

when it comes to like foggy situations these actually work really well too here

we got some footage taken with my iPhone XS Max just natively camera app all

that and here you can see a similar shop with the telephoto lens and the ND

filter this is ND 4 here's ND 8 and here's ND 16 and here's all three

so depending on what lighting environment you're at whether it's

studio light whether you're outside it's harsh especially during the summer

Trump is officially obese medical exam shows after he gained four pounds in a year - Duration: 8:54.

President Trump gained four pounds since his last physical, making him obese, his latest medical exam shows

Dr.Sean Conley said in a Thursday memo that Trump weights 243 pounds, which is four over the 239 that the president weighed in at last year

It was just enough for the president to be designated 'obese' by the government's standards

Conley said that no other major changes to his medical or surgical history took place and that routine labs were conducted during the four-hour physical at Walter Reed medical center that took place last Friday

In a letter to the president's chief spokeswoman, Conley said that Trump is 'in very good health' and expected to 'remain so for the duration of his Presidency, and beyond

' Additional reports and recommendations for the 72-year-old president who weighed in at 239 pounds at the time of his last check-up were still being worked up, Conley said

'The President is very grateful for the outstanding care he received today, and he especially wants to thank all the doctors, nurses, enlisted and civilian staff who participated,' Conley wrote

Conley did not provide any details about Trump's health in the letter the White House provided to press early Friday evening, aside from his assessment that the president is under no reasonable threat of developing a life-threatening condition

The results of Trump's last physical were disclosed by his doctor at a televised briefing for the press, where the president's doctor at the time, Ronny Jackson, made comments about his patient's health that were considered to be hyperbolic

He said that the president's 'good genes' had kept him in 'excellent' health, even though he admitted Trump need to shed some pounds

The president was deemed to be overweight, by government standards, but not quite obese

Jackson put him on a diet and exercise plan and gave him a goal of losing 10 to 15 pounds

The White House admitted on the eve of his Friday physical, however, that the president hasn't always followed it

'The President received a diet and exercise plan last year after his annual physical, but the President admits he has not followed it religiously,' White House spokesman Hogan Gidley told CNN

The U.S.president is a known lover of fast food who consumed McDonald's regularly on the campaign trail

He paid out of pocket last month for the Clemson Tigers to devour fast food when  the 2018 College Football Playoff champions visited the White House amid the partial government shutdown when serving a large meal cooked by staff was out of the question

'We ordered American fast food.Paid for by me.Lots of hamburgers, lots of pizza, I think they'd like it better than anything we could give,' Trump told reporters in January

'We have some very large people that like eating, so I think we're gonna have a little fun

' Trump brought in Big Macs from McDonald's and burgers from Wendy's and Burger King, along with Domino's pizza and french fries

'We have pizzas, we have 300 hamburgers, many, many french fries, all of our favorite foods

His choice of fast food for the event was unusual, but it is the president's favorite

'On Trump Force One there were four major food groups: McDonald's, Kentucky Fried Chicken, pizza and Diet Coke,' they wrote

They recalled that Trump would have 'two Big Macs, two Filet-O-Fish, and a chocolate malted' shake on regular basis

Lewandoski later clarified to CNN that Trump skipped the carbs, and that's why he ordered so many sandwiches

'Well, he never ate the bread, which is the important part,' Lewandowski said.'He was busy campaigning

We didn't have time to sit down for a meal.' During the campaign, Trump posted photos of his fast food meals on social media: eating Kentucky Fried Chicken (with a knife and fork) or a McDonald's hamburger with fries
