Today we're gonna discuss a little bit about premises liability claims.
Premises liability is basically a property owner being at fault for somebody's injuries.
Perhaps, the best example is a slip and fall in a grocery store when there's a liquid that
you don't see on the floor.
Now, these cases are very difficult to win and to prove, because you have to show that
the property knew or should have known of the dangerous condition, and had an opportunity
to do something about it.
In addition, North Carolina has that very harsh law that we've previously discussed
called contributory negligence, meaning even if the property owner is 99% at fault, if
you're 1% at fault, you're not entitled to any recovery.
In being 1% at fault in property liability situations means you should have seen what
you ought to see, and that's exactly what the law says.
So, they're difficult claims that they take some experience, some ingenuity and some know
how to put those cases together.
