Recently the welfare of animals has been an area of focus
due to the increased cases of animal abuse
Is the current law in Hong Kong able to prevent these things from happening?
We have interviewed the SPCA, let us hear their opinion
There are some things that are missing which are very common elsewhere
So for instance banning people who have a history of being cruel to animals
either from owning pets or owning animals for a certain period of time
or in serious cases, from working with animals or having contact with animals
in some jurisdictions we have that
In Hong Kong we have no powers to ban anybody who has been convicted of animal abuse and cruelty from owning an animal
So you could go to court one day
You could be fined for an offence
and if you dont have to go to jail you could go out the next day and get another animal
Again, it is not so clear in our legislation about duty of care
about the fact that it is possible to prosecute somebody for not doing something
or not taking action that they should have done.
A lot of the prosecutions that we do depend on the animal having suffered.
So the animal already has to have suffered before we can actually have a prosecution.
Whereas actually in some of the legislations if somebody has not done something they should reasonably do
and it could be expected that something horrible may happen as a result
they could be prosecuted
but at the moment we do not do anything like that
Having listened to the opinion of an expert
what do the citizens of Hong Kong think?
Oh, a few days ago a dog in Wanchai was thrown down from a building on to a car and died
but Hong Kong does not seem to have a very concrete or apparent law to protect them.
I am also not very familiar on the area of animal law
I do not have much understanding on animal law
In my opinion, I think there is probably a section in the law preventing animal cruelty
I know that there will be enforcing agents to enforce the law if someone commits animal cruelty
I see in the news there have recently been many incidents of dog poisoning
but even after a long time there has not appeared to have been any action
So I think that maybe there is insufficient protection for the welfare of animals in Hong Kong
I personally think that there could be more protection [yeah]
I dont understand the problem, I dont know anything about it.
I think there should still be some areas which can be improved
for example the areas of monitoring or penalties could be stronger
I think the penalties for animal abuse are insufficient
I think the Hong Kong government can make the laws more stringent to scare away people from committing the acts
and on a personal level schools can educate people that they cannot recklessly treat the lives of other beings badly
It seems like our current laws are imperfect
What can we do as citizens to help promote animal welfare?
To me, I think getting involved would be great
like everybody getting involved would be great
but I think that would be... Not yet
that would be a much much later part
I think understanding what it is
and why it affects us
That in itself would make a difference
and then once you know, then you do the change and adding in and the contribution
but it is knowing, it is knowledge
in terms of LegCo or the government
They have bigger power to help
but they are very very restrained by bureaucracy and what the people want
and if the people do not want or do not care about animal situations
because they do not know
the government is not going to care about it
