for watching us tonight let's get
straight to our top story the trouble
administration's battle over national
security during a news conference with
japan's Prime Minister 2day president
trouble reacted to the ninth circuit
court's ruling against the temporary
travel band and its potential impact on
America's security
listen we're going to keep our country
safe we'll be doing something very
rapidly having to do with additional
security for our country you'll be
seeing that sometime next week to make
that with reaction from the White House
Kellyanne Conway senior advisor to
President Trump for Kellyanne what's
this all about now I'm not because the
president called a new steps and we'll
be seeing them very rapidly
well we have many different options
moving forward as you know Erica
yesterday's decision did not affect the
marriage at all we're very confident
fully confident that will prevail on the
merits there's nothing that the Ninth
Circuit yesterday that has called into
question the president's ability under
the statute and under his constitutional
authority to keep the homeland safe
which is precisely his point so there
are a number of different steps we can
obviously go back to the district court
some people said he can get all the way
to the Supreme Court very certainly
always had the opportunity to put out
new executive orders but the president
will make that decision in due course it
isn't it clear that the branches are
equal under our Constitution and in this
case the court seemed to supplant it's
the president's judgment about national
security with its own right and not an
appropriate use of it of its power we
don't have one of the other options
available to the president is to
continue to travel that he could
literally take structures is is tsa the
border security to say hey we're going
to continue to travel down let the
Supreme Court tell us not it's not to do
that well and what the president said
today in that really remarkable joint
press conference with Prime Minister are
they had a terrific day together here at
the White House i'm meeting privately
first having lunch there after than
having that joint press conference for
all the witness what she said there is
that extreme bedding was his idea that
candidates from came up with that idea
when he was running based on the
information that he had received based
on the
agency that attend to these matters and
since and as president as
commander-in-chief of course the pieces
Kelly presidential briefing he has
access to information that you and I
don't and he is that much more convinced
that in the interest of keeping this
nation face that he will take the steps
necessary and we know constitutionally
and statutorily he is within his rights
if used to hang on the administration
through the courts are playing politics
well more broadly speaking we believe
that judges should not play politics at
all and we respect the fact that the
three branches are separate and
independent and also equal one is not
supreme over the other on a their area
their politics in any particular
judicial decisions and the president and
his folks people have a right to call
that out what what really concerns of
here is that a fair reading of the
faction the Constitution none of which
really were effect none of which were
affected at all by very gnarly prescribe
chiaro ruling the president is well
within his authority and i would add he
has the duty and responsibility to do
this and also eric it's something that
he put front and center in his campaign
Donald Trump beat a former Secretary
former united states senator who is
united states senator in New York on 911
who had a farm firstly he'd be that
individual based on his much more must
have much more clear and robust and
tough position on the matter i want to
go to you up but you mentioned 911 is
there any initiative that we look
forward to maybe next couple of days
next couple weeks in some sort of Gitmo
strategy going forward
well the president has said he will
adjust any number of the issues that he
talked about during the campaign i
remember first and foremost this man
that I work with every day he is focused
on the nation's security and now in that
regard he has stated in the past
addition on Guantanamo Bay is stated his
position on terrorism he stated
traditional Isis are not to be contained
and or no ignored they are to be
eradicated also faced years even even in
joint press conference in his
meeting today with Prime Minister are
they of course they're talking about how
their relationship is the Japanese us
relationship is one of the cornerstones
of freedom and and prosperity and
democracy but it also goes to national
security interest of security interest
international let's talk about this
little bit also today it's been
resonating Washington Post Commander as
you probably know I appointed secretary
flame had talked to the Russian people
about sanctions prior to Donald Trump
being sworn in as next president for
your president the united states which
would violate some some laws some rules
I'm Governor Mike Pence responded this
way I talk to general plan about that
that conversation they did not discuss
anything having to do with the United
States decision to expel diplomats and
for composers since you're against
Russia so where to stand still here for
one says he doesn't recall making those
comments with the Russians regarding
sanctions Washington Post wings at nine
sources your thoughts with it where is
the administration on that my thought is
it's not for me to comment any further
on that at this time
Eric I i will repeat that vice president
Pence's office or a spokesman has said
that the vice president in that TV
interview with basing his comments on a
conversation that he had with general
Flynn all of that is not in the public
domain so I just repeatedly that their
you show you the Washington Post got it
wrong i think that these are very highly
sensitive matters and i would prefer not
to comment any further I'm one of the
other topics bubbling up all week as you
know we kick off the hand comment they
were mark you made about advantage from
clothing line he said you would support
it that it created quite a stir
we take a listen to little sounds from
jason Chaffetz Town Hall discipline we
that a very candid very direct letter to
the White House and the office of
government ethics they need to
investigate it what the aliens on
it was long as you never happen again so
I can tell me the president he i think
he gave you some words of support he
didn't beat that part I will reveal he
said he backs me one hundred percent and
that he knows that and and that he will
leave it at that and mother were dumb as
i said before i'm very blessed to work
for a man who's been pro-woman his
entire career he has hired and promoted
women in the trunk corporation the trunk
campaign the trunk cabinet the trunk
west wing
it's just natural to him to do that and
I appreciate the fact that he
understands i meant no malice and that
he backs me when he understands the fire
that we all take here as well I just
hope that sometime soon
Eric that the president forget me the
president is he was elected will get the
credit he deserves for injustice first
short three weeks boosting weight is
helping to create jobs for tech jobs
keeping here making meaningful steps
towards tax before we're going to have a
taxi beach and tax reform this country
that we've never seen before even close
the wheels off the 1986 that we feeling
replacing the voluntary doing amazing
things for this country and I don't want
to be just a distraction i just wanted
to get the credit but i'm really happy
support you think shaping strong little
too far with this is this of water
individuality
I'm not going to comment on congressman
chairman Chaffetz particular comment
about me I just know it was a really
rough town hall because i watched it on
TV and I know that the district he was
seventy-five percent of vote but he
seems that there seems to be a lot of
folks they're trying to make their point
on opposition party certainly the
Democrats I think the political left
more generally is very animated and a
little bit hysterical these days look
what they've done to our Supreme Court
nominee looking under cabinet nominees
are 047 now what were all those
sleepless nights worth of stuffing and
trying to
embarrassing humiliating and we have
Betsy DeVos and tom price and jeff
sessions in the restroom in our cabinet
now will continue to I think all of our
nominees will be confirmed as president
put together the most conservative and
most qualified brilliant cabinet in
modern memory and he deserves to have
them all confirmed we need Secretary of
Commerce and Treasury and agriculture
self showy and I appreciate your time by
using them up against the break thank

next what can the Trump administration
do next after the Ninth Circuit's
refusal to reinstate the travel band at
the base moments away
any impact segment tonight the fallout
from the Ninth Circuit's ruling against
president Trump's travel ban following
last night's decision Washington State's
Attorney General who has led to push
against the band sounded off about what
he thinks the president should do next
the President does have a choice he can
continue to fight this or you can carry
this executive order and start over i
would strongly encourage him to consider
the latter for selection but is that the
right way to go
joining us now to analyze from santa ana
california champion Chapman University
law professor John Eastman and from
Washington Jesse burns associate editor
at the hill start with you such a recent
the right way to go we've heard all day
what the Trump administration plans to
do
looks like they're going to go back and
you go back to the Ninth Circuit and
they also may write another CEO
executive order
what should he do but i don't think
those are mutually exclusive I think you
should do both
I mean the fact of the matter is so this
this attorney general it's been a
challenge whatever he does with his
executive order because the one that he
previously issued was patently
constitutional square on and support
authorized by the existing law a lot i
might add that neither the Ninth Circuit
the nord Robarts bothered to cite in
their opinion saying that President was
unlikely to succeed on the merits and so
I think the president should continue to
go back to the trial court and and lay
the case out buddy auto issue new
executive orders segmenting each of the
components of this one then ok you say
there's a due process right for people
coming over from Somalia who have never
been here
the Supreme Court has said otherwise
numerous times here is that executive
order yeah so I'm going to get Jesse
bernarr just burns if it's not there
been constitutional law professor all
day talking about if you take the
executive order on its merits not
understanding but on its merits likely
the Trump administration will win if the
Supreme Court level what the Ninth
Circuit found one of the two things that
its rules essentially look at it
rejected the government's argument that
they had to reinstate this travel and
immediately for national security
reasons of course if it goes to the
Supreme Court and it's there seems to be
some confusion over whether the
compensation will actually go that route
except tonight that all options on the
table but if it does go to the Supreme
Court right now there are only eight
justices so if
deadlock for for this nice Circuit
ruling which essentially lost his travel
plans would be the one that would remain
in effect professor you agree that you
think that would end up being a 4-4 tie
the Supreme Court level at this point i
would hope not i would hope it would be
at least 62 and quite frankly I hope
there would be unanimous the law is so
patently clear here the picnic the
Supreme Court itself has said questions
of who to admit into the United States
or not is solely within the powers of
the political branches largely immune
from judicial review and and the statute
that gives the president authority here
could not be more clear that the
president has this Authority so i would
hope that the supreme court would decide
that unanimously and push back with
quite frankly and I can't I said in your
your other guests magazine earlier today
our newspaper
I think this is a coup d'etat try that
by the judiciary unwilling and refusing
to recognize the results of the election
last November yeah and just use it
possible that this Court I mean we know
the Ninth Circuit's a little court we
know that there are other circles you go
to Texas you'll have probably more
conservative opinion coming out of Texas
but the Ninth Circuit decided to take it
up and decided to push back on Trump's
travel ban well there ya a variety of
options here one thing that kind of
broke late tonight was that we
understand a judge on the Ninth
Circuit's requesting a full panel to
review of course the ruling yesterday
was just from a three-judge panel is
unanimous which does complicate the
president of unanimity liberal circuit
right so you know this the compensation
conditions to pursue this at the ninth
circuit level which could happen in the
next couple weeks we don't know yet than
that no court is gonna be the one it at
play but the bigger alluding to what
John said earlier if it plays out in the
federal district court up in Seattle the
merits of the case is what the
administration feels like they've got a
stronger case on and the and Trump is
going to you know continue to play it
out there at the same time he might
bring forward a separate executive order
if you want something to get done
professionally throughout the day there
were rumblings that possibly the court
was upset that we lose a professor we
have a professor is you can I think we
lost professor I asked you that Jesse
okay professors that there's rumblings
all day today that maybe the court was
upset because at one point struct
president trumpet said that the court
this isn't even a case
record it should be heard by the court
and they push back on that yet knowing
it is that there's a provision in the
law on every occupation of these it's a
the Secretary of State has that
authority and and the Congress has
specifically deprived the lower courts
have any jurisdiction to consider such
matters because they recognize this is
in the core wheelhouse of the executive
power week you know what was the
Department of Justice supposed to do in
open court at the hearing earlier this
week announced all of the intelligence
we have about which people were
following and who might be terrorists
coming into this country so that we
advise him mean there's a reason the
executive operates in certain areas
outside of judicial review and this is
one of them and and you know the
combination of the executive and the
Congress here like I say it is palpably
clear the president was well within his
authority here and just a final thought
on this not gonna give you 30 seconds to
show on it is not unusual for president
to a first lose on appeal and then when
Eddie this prion reappear another peel
orange cream court level
yeah i know we thought with the Obama
administration the Ninth Circuit or
local courts in general and being those
challenge of going to Supreme Court
missing a different ruling but I think
something to remember with all of this
is that disorder that restraining order
that was imposed last week in Seattle
that's going to stay in place until
there are some type of other ruling and
so at this point the Trump
administration what they could do and
what their what we're expecting at this
point at least is to them to craft a
meeting narrower executive order that
exempts some of these refugees and while
pursuing this little k alright I gotta
leave right there Jonny Jessie thank you

most successful peacetime alliance in

trying to break up the EU he's conniving

determined to drive out out of the upper
middle east Syria Iraq the upper gulph
and he's very successful he's alive with
our archenemy Iran you over the top
you're not gonna even more now getting

in Syria driving their relatives in the
arms of the gre's and oh by the way he
murders his political opponents
journalists activists but he does have
one redeeming quality it is love dogs ok

those things you mentioned are horrible
and bad that they frankly don't threaten
the United States per se i will however
make the case that Iran does he

death to America their weaponizing the
testing ballistic missiles they're ready
to be nuclear i would say in a finance
terror that ends up coming
go our shores of times i would say Iran
is greater threat than Russia well the

are published essays defending last
week's ride again spread apart editor
Melo's monopolist
any unresolved problems segment tonight
the far less war against free speech
last week the university of california
berkeley descended into violent chaos
the head with speedfight right by editor
my love the anomalous the right cause
more than one hundred thousand dollars
in damage and forced to speeches
cancellation despite that UC Berkeley
student newspapers now published five
essays actually praising the violence
and opposing annapolis is right to speak
then it's not analyzed from Washington
from the National Center for Public
Policy Research horace cooper along with
Jamila Bey a radio talk show host now
Miller start with you we all know about
the the right of free speech but in the
in the Constitution's talked about as a
peaceful protest in other words peaceful
protests are protected not violent
protests absolutely up and frankly these
young students at Berkeley who are among
the smartest in the world put themselves
on the line and defense of their fellow
students one of the highest things that
we hope our our people do in battle and
they're doing it already at school to
say we do not accept the violence that
meelo Milo I'm sorry i mispronounced
name brings to the people he chooses to
out i'm bringing bringing out there
today three people who just you know we
agree that we agree on the right to
protest the great but they we disagree
on the part where the violence was
actually I don't know what LM a pedestal
by UC Berkeley 50 edge published
praising the violent part of it
well these students are young people and
I'm sure that they may even change their
minds but the arguments they made were
sound and what how did not discover
horse yeah I don't you cut you off but
how can you make it sound argument when
the Constitution clearly put extra speak
but not violent free speech morning when
they cost to update my will bring horse
and driving and here's the thing these
arguments what about being sound these
arguments were about justifying violent
if five people go to a Woolworths
restaurant to peaceably demonstrate that
they believe they should have the right
to be there
the
rhetoric that was demonstrated in these
op-eds and the behavior that we saw at
Berkeley means that it would have been
okay for masked intruders to go to the
Woolworth and beat the hell out of them
because they don't agree with what
they're sending for the First Amendment
purpose it for us have a simple
disagreement to bring the strong
argument not violent
this was a terrible example and if
they're this bright than this is
dangerous assignment overhead and you
know it you know
UC Berkeley claims to be the birthplace
of free speech let's talk about the free
speech on Milo's part he wasn't allowed
to speak he wasn't allowed to get up and
read a list of the illegal he wasn't
allowed to get up and give information
that was going to be able to make it so
that those who would do harm to such
students could find them could find
their professors to find their family
and friends that's what these students
were protesting yeah let me learn to
pick yours he was allowed a list
realistic or give information you would
like to do that yet the protesters were
allowed to be right as in violent parts
yet this is an argument that somehow
something someone is going to say give
me a hecklers veto not just to interject
myself but to burn the place down to
threaten an assault and attack people
what if this had been a gay pride event
on the campus and some individuals
decided to put mats on and they were
going to shut this down because they
didn't agree and they were going to do
it was violence
well that's certainly what I deliverable
this is unacceptable what is
unacceptable is that Milo has made
millions of dollars on going and
bringing violence and bringing pair two
individuals he doesn't like we know that
he went on a college degree out if that
whatever
absolutely true my only I want everyone
knowing what we decided he had not
injured one person he has not already
went by the act not only on my honor and
wrong you are absolutely wrong
Milo got kicked off of 21 jul hear about

but what I look different but clarified
you know what what violence did Milo
himself arbitrate i Milo himself did not
throw a brick like her Lafleur Milo said
hey everyone it's got one said anything
like that just be that may be discussing
speaks to some people but it is that'll
protectively a threat that's not
protected on a horse your hand of blood
for you doing there
berkeley students have the water they
know we're standing over your bed early
tomorrow
I wonder where those who do not have the
wing will throw a brick at you all right

class they stood up together they spoke

cracking down on illegal immigration
immigration officials in Phoenix are
under fire after following through with
the 2013 deportation order against the
illegal immigrant convicted of felony
criminal impersonation the when the
woman's deportation leading to fierce
protests among immigration activists
they claim immigration officials are now
targeting individuals who pose no
violent threat today homeland security
secretary John Kelly defended the
deportation on the right people being
reported they were picked up they were
accepted to remove their court orders
against all of removing these people and
again some of them are flat removal for
years and years and years so when
they're when the electron out so to
speak and an immigration judge said this
person male or female whatever needs to
be removed and they go remove them the
argument that they've been here for so
many years i think is is not a strong
argument
joining us now with reaction from

mclaughlin died Christmas start with you
your thoughts on this removal look they
broke the law they need to go right and
Donald Trump always said that if you
became president this is what he's going
to do he's going to prioritize
deportations of criminals first and this
is what his executive order said the
thing is going for him is that with this
action and with the actions taken
against sanctuary cities is among the
most popular things we're seeing in
public opinion polls with all the things
president some sort of said he wanted to
do I think the question is going to come
down to the implementation as they're
going around and beginning to deport
more and more people are they actually
getting the violent folks or have a cap
straps to wider net you're casting
people with more sympathetic stories and
crafts more of a reason to stay because
you know your thoughts on on the
politician you know I agree that is
ultimately she was a challenge with a
convicted felon
it's a very sympathetic story of course
she was brought here is a
fourteen-year-old and so i'm not sure
that you mix the best case if you're
concerned about making pragmatic
solutions celebration if you really want
something you want to really really want
to take a hard-line she's a great case
because it really shows it
he's willing to put pretty much anybody
I i don't agree this political headline
it says this past weekend Ice engaged in
concerted nationwide enforcement
operations to take into custody and
return adults who entered this country
illegally and with children now
Christian here's the catch that
political headline is from january 2016
under the Obama administration jeh
Johnson you're absolutely right and
obama got a little bit of flak from the
left some folks call them to porter and
chief but certainly you did not see the
level of outrage that you're likely to
see here when it comes to president
Trump that now folks on the left for
whom they may not have been so eager to
criticize President Obama now the
president trumpets are taking this
policy and dialing it up to eleven
actually putting some peace behind that
you're going to see a lot more people
turning out in the streets to protest
and yeah you know so we pointed out that
this is not new under President Robert
president max we started in fact this
person was quite in 2013 now and
absolutely they were I thread back in
Massachusetts early in Obama's
administration and he supported about 3
million people so he's done a lot of
work at the border particularly I think
the issue here is whether people want to
see people here illegally have a
possible for division or citizenship or
not and about fifty percent of americans
actually want to see that whether that
citizenship or legal status which
implicates the voting rights of these
people have another question altogether
but there is I think public support for
it and I think that's what Trump with a
lot of different rows of chumps know and
they're Christian there is word that the
President may have been opened to the
gang of eight and some of that some of
that pushed it's not a lot of
citizenship for people who are here
illegally and then they walk it back a
bit your thoughts
yeah that makes sense to me that they
would lock it back a little bit just
because the gang of eight bill had been
so politically toxic on the right it was
one of the things that people would
criticize someone like Senator Marco
Rubio for having supported he walks back
his support for eventually but right now
if if you're the President of the United
States your job is to execute the laws
that you've got in front of you and
right now unfortunately because there is
no comprehensive immigration reform
you've got a lot of folks that you can
make a really compelling case that they
deserve to be able to stay but there's
no legal path for them to be able to do
so
so if you're president you're hands are
kind of tied your job is to execute the
laws as they are on the books
the Congress to decide what they want to
do legislatively about fixing that if
you think I'm one of the things is that
president candidate Trump promises
president Trump is going to do exactly
this thing you know he did and his
electorate wants to see those promises
being implemented but we're still
thinking I could give another example is
the war sixty percent of americans are
against that now that they think that
everyone has to pay for the tax dollars
so campaigning one saying company is
another let's see what happens i can
pick the wall back now I'm you promised
the wall he did promise the world but as
if it becomes politically toxic he's
gonna have to make it efficient all
right Christian then you're going to say
