Leila braces for arrest, vows to sue Aguirre (14.02.2017) - Duration: 2:35.

Sen. Leila de Lima said yesterday she was bracing for her possible arrest even as she

vowed to file charges against Justice Secretary Vitaliano Aguirre II before the Office of

the Ombudsman for alleged tampering of witnesses against her.

"He is unfit to be in his position," De Lima told reporters.

She said she expects her co-accused – mostly drug convicts at the New Bilibid Prison – to

turn state witness against her, leaving her as the lone accused in the complaints.

De Lima maintained that the proper venue for the complaints against her should be the Office

of the Ombudsman.

And if ever the cases go to trial, this should be done by the Sandiganbayan, not the regular

courts.

Last month, she filed two urgent motions to stop the Department of Justice (DOJ) from

proceeding with the investigation on jurisdictional grounds before the Court of Appeals (CA).

She lamented the CA has yet to act on her petition amid rumors that some of the justices

have inhibited from tackling her petitions.

In the motions filed on Jan. 13 and 30, De Lima noted the "obvious bias" as she sought

the transfer of the cases to the ombudsman.

De Lima said she hopes to get a temporary restraining order (TRO) for the case even

as she is prepared in case the complaints are filed before the regular courts.

"I'm hoping a TRO will be issued.

I filed two successive urgent motions to resolve my prayer for TRO," she said.

"For now, I'll wait for that eventuality and see what my lawyers can file again when

the DOJ files the case in the RTC (regional trial court) and seek an issuance of warrant

of arrest for a non-bailable offense," she added.
